General Terms and Conditions – Brand Ambassador

These terms and conditions of the Brand Ambassador program apply to all ambassadors cooperating with the companies listed below, which together form the 11Teamsports Group:

(hereinafter referred to as “11Teamsports Group”)


1.     Participation in the Program

1.1.    To participate in the 11Teamsports Group Brand Ambassador program, all required fields in the registration form must be completed correctly and fully. By submitting the application, the participant confirms that they are at least 18 years old.

1.2.    11Teamsports Group reserves the right, at its sole discretion, to accept or reject any applicant. Submission of the application does not guarantee participation in the program. The cooperation agreement is established only upon acceptance into the program, creation of a profile in the AffilBox system, and receipt of the welcome email.

1.3.    The Brand Ambassador’s account may be immediately deactivated or terminated by 11Teamsports Group if there is objective evidence of a breach of essential contractual obligations, particularly regarding compliance with legal regulations and proper labeling of advertising.

1.4.    The Brand Ambassador must maintain an active profile on at least one social media platform (Instagram, Facebook, YouTube, Twitter, TikTok, Pinterest, or a similar platform).

1.5.    If Instagram is designated as the main profile, the Brand Ambassador must have at least 500 followers.

1.6.    The Brand Ambassador agrees to publish content related to 11Teamsports Group products and activities as part of the collaboration. 11Teamsports Group is entitled to further use and distribute such content, both online and offline, through its communication channels, for an indefinite period.

1.7.    Participation in the program does not establish an employment relationship between the Brand Ambassador and 11Teamsports Group. The Brand Ambassador acts as an independent contractual partner, and no corporate or employment relationship arises between the parties.

1.8.    The Brand Ambassador undertakes to generate at least six (6) orders in the first quarter of cooperation. Failure to meet this commitment will result in placement on the so-called “red list.” If fewer than three (3) orders are generated in the following quarter, 11Teamsports Group is entitled to terminate the cooperation.

1.9.    The product budget is determined based on achieved performance.

1.10. The Brand Ambassador must publish a review of the provided products within thirty (30) days of delivery. The seeded products remain the property of the Brand Ambassador. The Brand Ambassador is responsible for proper taxation of any non-monetary benefits received.


2.     Obligations of the Brand Ambassador

2.1.    The Brand Ambassador undertakes, in particular, to:

2.2.    Refrain from any conduct that could be considered misleading, including cooperation with competitors or resale of provided products.

2.3.    Refrain from conduct that may damage the reputation or public image of 11Teamsports Group.

2.4.    Not to share discount codes, vouchers, or gift cards provided as rewards with third parties, as these are intended solely for the Brand Ambassador’s personal use.

2.5.    Not to run paid advertising campaigns (PPC); however, sharing affiliate links on the Brand Ambassador’s own profiles is permitted.

2.6.    Not to disclose to third parties any information, rewards, or activities available through the Brand Ambassador program.

2.7.    Not to share their personal discount code with third parties (e.g., discount portals, coupon websites, other influencers). In case of breach, the code will be deactivated immediately, and commissions will not be paid.

2.8.    Comply with all provisions of these General Terms and Conditions.

2.9.    Accept the General Terms and Conditions of the AffilBox program.


3.     Compensation

3.1.    Commissions are paid through the AffilBox system. To receive payments, the Brand Ambassador must have an active affiliate account within this system.


4.     Duration and Termination

4.1.    11Teamsports Group reserves the right to discontinue the Brand Ambassador program at any time.

4.2.    Unless otherwise agreed, the cooperation agreement is concluded for an indefinite period. Termination may be effected at any time in written form without providing a reason. This does not affect the right to extraordinary termination.

4.3.    11Teamsports Group is entitled to terminate the Brand Ambassador’s participation due to inactivity.


5.     Liability and Indemnification

5.1.    The Brand Ambassador shall be liable exclusively for breaches of the obligation to properly label advertising on social media or for other contractual obligations, particularly regarding the use of third-party protected content.

5.2.    The Brand Ambassador undertakes, upon the first written request of 11Teamsports Group, to indemnify the company against all third-party claims arising from such breaches, at their own expense.

5.3.    11Teamsports Group shall be liable without limitation for damages caused intentionally or by gross negligence, and as stipulated by the Product Liability Act. For damages caused by slight negligence, liability applies only in cases of injury to life, health, or bodily integrity.

5.4.    In all other cases, liability for slight negligence is limited to the breach of a material contractual obligation, the fulfillment of which is essential for the proper performance of the agreement and on which the Brand Ambassador may reasonably rely. Compensation in such cases is limited to foreseeable, typical damages at the time of conclusion of the agreement. This limitation applies equally in favor of representatives and agents of 11Teamsports Group.


 

6.     Final Provisions

6.1.    Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

6.2.    If the Brand Ambassador is an entrepreneur, a public-law entity, a special fund under public law, or does not have a registered office in Germany or the Czech Republic, the exclusive place of jurisdiction for all disputes arising from this agreement shall be one of the registered offices of the companies forming 11Teamsports Group.

6.3.    Agreements between 11Teamsports Group and Brand Ambassadors shall be governed by the law of Germany and the Czech Republic, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

 

These terms and conditions are effective as of 15 September 2025.
